These Terms of Use (“Terms”) govern your use of the In the Welsh Wind Distillery Limited (“In the Welsh Wind”) website. By using the website you are indicating your acceptance of these Terms. In the Welsh Wind may change the Terms at any time by putting amended Terms on the website. If you do not accept these Terms please do not use this website. The Site is intended for use by you only if you are of legal age to purchase alcohol in your country of residence and in the country from which you are accessing the Site. If you do not fall within this category, you may be in breach of laws or regulations applicable in your country of residence or in your country of access and you should leave the Site immediately.

Copyright
The information and images contained on the website are the property of In the Welsh Wind and are protected by copyright laws. All software used on this website is the property of In the Welsh Wind or our software suppliers and is protected by copyright laws. The content of the website may not be distributed, modified, reproduced in whole or in part without the prior  written permission of In the Welsh Wind.

Trade Marks
In the Welsh Wind, Limbeck, Madam Geneva, Young Tom, Pembrokeshire Pinky, Cardiff Dry Gin, Dewi Sant, Black Batch Rum and other marks used on the website are In the Welsh Wind’s trademarks and may not be used  without In the Welsh Wind’s prior written permission. You may not use any meta tags or any other hidden text using In the Welsh Wind’s names or trademarks without prior written permission.

Intellectual Property
In the Welsh Wind owns intellectual property rights in the website. This includes, without limitation, database rights, rights in designs, rights in know-how, patents and rights in inventions, whether registered or unregistered.
Information gathering.

You may not use any data gathering or data extraction tools, such as robots, on the In the Welsh Wind website without the prior written permission of In the Welsh Wind.

While In the Welsh Wind has taken care in preparing the contents of the website and except as set out below, In the Welsh Wind does not accept any responsibility for any loss or damage arising out of or in connection with the use of the website including, without limitation, indirect or consequential loss or damage, loss of anticipated revenues, loss of business opportunities, loss
of goodwill, loss of data or damage to reputation. Nothing in these Terms shall operate to limit or exclude In the Welsh Wind’s liability for 

- Death or personal injury caused by In the Welsh Wind’s negligence
- Damage suffered by you as a result of any breach by In the Welsh Wind of the condition
as to title under Part 1 of the Consumer Protection Act 1987,
- Breach of the warranty as to quiet possession implied by Section 12 of the Sale of Goods Act 1979 or Section 2 of the Supply of Goods and Services Act 1982; or for fraud (including, but not limited to) fraudulent misrepresentation.

In the Welsh Wind does not guarantee that access to and use of the website will be uninterrupted or error-free. From time to time In the Welsh Wind may suspend or restrict access to the website to carry out repairs, maintenance or to introduce new facilities.

In the Welsh Wind does not warrant that the information on the website is accurate or complete and is not responsible for checking that information is accurate or complete. 

Mention of third party products, services, companies and websites on the website is for information purposes only and constitutes neither an endorsement nor a recommendation. 

Please note that all third party products must be ordered directly from the third party.

The website contains links to websites run by other organisations. While every effort is made to check the content and accuracy of the websites In the Welsh Wind links to, In the Welsh Wind takes no responsibility for  information contained on websites maintained by other organisations or for action taken as a result of information contained on websites maintained by other organisations.

Product Terms and Conditions
If you apply for a product or service through the website, any additional terms and conditions which relate to that product or service will also apply. If there is any conflict between the provisions of the terms and conditions relating to the product or service and these Terms, the terms and conditions relating to the product or service will take precedence over these Terms.

Framing
You may not frame the website without In the Welsh Wind’s prior written permission. 

Severance
If any provision in these Terms is declared void or unenforceable by any court or other body of competent jurisdiction, or is otherwise rendered so by any applicable law, such provision shall to the extent of such invalidity or  unenforceability be deemed severable and all other provisions of these Terms not affected by such invalidity or unenforceability shall remain in full force and effect.

Waiver
No delay or failure by In the Welsh Wind in enforcing any provision in these Terms shall be deemed to be a waiver or create a precedent or in any way prejudice In the Welsh Wind’s rights under these Terms

Jurisdiction and Governing Law
These Terms shall be governed by and construed in accordance with the laws of England.

Any dispute arising under these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of England. The products described on the website are available only to residents of the United Kingdom. In the Welsh Wind will not accept applications from persons located outside of the United Kingdom.

Purchase of Goods
Age Restriction
No person under the age of 18 years (for customers within the UK) may place an order. For other countries, local age restrictions apply

Personal Use
By accepting these terms and conditions you agree that the products you purchase via this web site are exclusively for your personal use and are not for resale. For the avoidance of doubt, these terms and conditions apply to retail customers only.

Payment and Title
All purchases remain the property of In the Welsh Wind until paid for in full. Payment must be received in full together with the delivery charge and VAT (where applicable) before the items are dispatched to you.

Payment Details
To protect your Credit or Debit card information, we use a specialist Payment Services Provider who is compliant with the VISA and MasterCard PCI (Payment Card Industry) standards.

We don’t record or store your card details, and no In the Welsh Wind employee has access to any card details 

Cancellation of Orders
If either party cancels an order prior to dispatch and you have already paid for the goods, you will receive a full refund.

Delivery
In normal times and under normal circumstances, we expect to deliver within three working days to the UK Mainland. Deliveries are not made on weekends or UK National holidays. Delivery will be made to the address specified by you on your completed, who must be a person over the age of 18 years. 

We will endeavour to ensure delivery within the specified period, however we  will not be held liable for any delay in you receiving the items for whatever reason.

Orders are processed with all possible speed; if you have not received your goods within 28 days, please contact us.

Damaged Goods/short delivery
In the event of damage or short delivery, please contact us at the distillery within 3 days of delivery. We will normally ask to see proof of the damaged goods – for example photographs before making any decision about how to proceed. If you do not contact us within 3 days of delivery, you will have accepted the items.

Where we receive suitable proof of the damage/short delivery, we will either replace them free of charge or refund your money including the cost of delivery, within 48 hours of receiving the returned products, which must be returned to us within suitable packaging to prevent further damage.

Returns
Upon receipt of the goods, if you believe that the items do not conform substantially to their corresponding description you must inform us within fourteen days of receipt of the goods. After this period you will have accepted the items.

If we accept the grounds on which you believe the goods do not conform substantially with their corresponding description, we will offer you a refund on receipt of the returned goods. We will refund your money within 48 hours of receiving the returned products, which must be returned to us in good condition. You will be responsible for the cost of returning the goods.

Giveaway Terms and Conditions

From time to time, we run 'giveaways' on our social media channels including but not limited to Facebook and Instagram. Unless otherwise stated, the following will apply.

We will always follow the rules as published in respect of any platform on which we run a giveaway to the best of our ability. We (In the Welsh Wind Distillery) are wholly responsible for the giveaways we run. We will only select prizewinners from the entries that have been submitted by the time and date stated in the giveaway post.

Unless otherwise stated, we will select winners at random from entries using, where appropriate, apps or other functionalities that allow us to make random selections from a list of entrants. In the event of any disagreement or dispute over the winners of any specific giveaway, or their selection, the decision of a director of In the Welsh Wind Distillery is final.

We can only post out prizes to selected winners with a UK mainland posting address. We can only post out prizes to selected winners who are aged 18 or older. No cash alternative is available to the prizes offered.

By entering our giveaways, you agree to us announcing you as a winner in the manner indicated in the giveaway announcement post.
